These terms and conditions (“Service Conditions”) are intended to govern the access to and use of the Payment Service (“FAC-X Service”) provided by FaciAngola - Payment Services Provider, Lda, hereinafter FaciAngola, whose acceptance constitutes a binding contract between the customer and FaciAngola, a company providing payment services authorized to provide electronic payment services;
When you activate your FaciPay Account, you accept and agree to comply with these terms and conditions of use. Therefore, you must read and understand these Conditions of Use and, if you do not agree, you must not proceed with the activation and/or use of the services.
These Terms and Conditions, the registration form, the schedule of fees for the services and products, the privacy and cookies policy, form a single legal contract “Contract” between the user of the FACI-X services and FaciAngola – Payment Services Provider Lda.
It is understood that not all services described in the terms and conditions or made available on the digital platform are provided by FaciAngola. The utility services are made available by other commercial companies in a commercial partnership with FaciAngola. You may find all details regarding these entities responsible for the services in the list of relevant entities and parties, attached to these Terms and Conditions.
2. DEFINITIONS
The following definitions relate to the Conditions of Use:
2.1 “Administrator/Depositary” means FaciAngola-Payment Services Provider,
Lda, which holds the aggregate of all payments and amounts equivalent to all transfers of electronic money in its FaciAngola Account from other Customers on deposit for you in your Account;
2.2 ‘’FaciAngola – Payment Services Provider Lda, with head office at Condomínio Belas Business Park, Edifício Bengo, room 109, municipality of Talatona, in Luanda, is a non-banking financial institution, a provider of payment services, licensed by the National Bank of Angola to issue and transact electronic money, to natural and legal persons, through the purchase and sale of utility services, payments, transfers and cash withdrawals, as well as any other services inherent to and/or related to its activity;
2.3 ‘’FaciPay’’ means the technological solution and its components operated by FaciAngola - Payment Services Provider, Lda, through which financial transactions are carried out that enable: depositing, transferring, withdrawing funds and making payments for utility products and services;
2.4 “FaciPay Account” is a "virtual" account that stores your electronic money and also allows you to obtain access, through the FaciPay application, to different services, including payments. We use the term "money" to refer to electronic money;
2.5 “Agent(s)” means the person(s) registered by FaciAngola, to sell the services made available at the Facipoint:
2.6 “Goods and Services” means the goods and services that can be purchased from Authorized Retailers using FaciPay;
2.7 “Beneficial Owner” means any person designated by the customer in the solution or via USSD message, to be the beneficiary of the monetary amount, which they designate to be transferred by debit from their Account;
2.8 “ID No.” means the number associated with the form of identification provided;
2.9. “FACI-X Services” means the services provided by FaciAngola-Payment Services Provider, Lda, through the FaciPay application, for the issuance and withdrawal of electronic money and the transfer of electronic money between Customers based on their instructions, including the recording of all transactions, their verification, confirmation and updating of records of the Customer's Account;
2.10. “Facipoint” means the mobile equipment, which allows transacting through the sale of the products and services made available by FaciAngola;
2.11. “Customer Support Service – S.A.C” means the Customer contact center;
2.12. “Conditions of Use” means these terms and conditions which may, at any time, be altered by us, amended or supplemented in accordance with the existing economic and regulatory conditions;
2.13. “Account” means your FaciAngola Account, and the record of the value of the electronic money;
2.14. “Fees” means the actual costs for the use of the FACI-X services, as per the attached table;
2.15. “Contract” means these present Terms and Conditions of Use, together with the Registration Form, list of third-party entities, Privacy Policy;
2.16. "Prepaid Payment Account" or "Postpaid Payment" Account means the Bank Account maintained by the Administrator in which all payments are made and held on deposit on behalf of the Customers;
2.17. “Customer” means a person under whose individual or commercial name a payment account is registered on the Facipay platform (FaciAngola);
2.18. “Charges” means the fees, commissions and other charges due under this contract for the FaciAngola services and products;
2.19. “Debit” means the movement of withdrawal of funds from your Account;
2.20. “Electronic money (E-Money)” means monetary value denominated in electronic currency issued by FaciAngola-Payment Services Provider, LDA, and stored electronically on the FACIPAY platform;
2.21. “Mobile Device” means the mobile phone, tablet and SIM Card or other equipment that, when used together, allows access to the FACI-X services and, in each case, is approved for use in Angolan territory by the competent authority;
2.22. “Registration Form” means the enrollment form containing the registration data and the corresponding acceptance of these conditions of use, as attached;
2.23. “Transfer Order” means instructions given through the technological solution or SMS for the transfer of electronic money from one Customer to another;
2.24. “Store” means any store, unit or other sales premises, operated by an Agent;
2.25. “We” or “our” means FaciAngola - Payment Services Provider, Lda, or FaciPay (digital platform);
2.26. “Verification Code” means the verification code generated by the application for the confirmation of transactions;
2.27. “Access Password” means the personal, secret and non-transferable identification code adopted to access and operate your Account;
2.28. “Network Service Provider” means the mobile telephony service provider;
2.29. “Network” means the Global System for Mobile Communications ("GSM"), covering the territory of Angola;
2.30. “Commercial Customer” means a merchant of goods and services who accepts electronic money at the time of payment for products and services;
2.31. “Credit Balance” means the permanent electronic money, from time to time credited to your Account;
2.32. “Mobile Phone” means your mobile telephone device;
2.33. “Individual Account” whose enrollment in the FACI-X services only requires the digital acceptance of these present Terms and Conditions;
2.34 “Business Account” whose enrollment in the FACI-X services requires your presence before a commercial agent at the time of Account opening;
2.35 “Agent Account” Account intended for the promoters of FaciAngola's services and products, whose enrollment in the services requires your presence before a recruiter at the time of Account update/opening;
2.36 “Transactions” means one of the operations specified in clause 8.5;
2.37 “Debit Transaction” means any transaction that results in a debit of electronic money from your Account, as verified by FaciAngola;
2.38 “Credit Transaction” means any transaction that results in a credit to your Account with electronic money, as verified by FaciPay;
3. “OPENING OF AN ELECTRONIC MONEY ACCOUNT”
The following persons who meet the following requirements may join FaciPay:
3.1 Any Angolan or foreign citizen, over 18 years of age, for private purposes or for commercial purposes;
3.2 National or foreign citizens under 18 years of age may open an account provided they are authorized by their parents, guardians or by whoever has the minor in their care, provided it is for private purposes;
3.3 Legal persons with head office in the country, characterized as micro or small enterprises;
3.4 Upon opening the Account, the following information regarding the Customer's identification will be collected:
3.5 Data of natural persons;
3.5.1 Full name;
3.5.2 Date of birth;
3.5.3 Marital status;
3.5.4 Gender;
3.5.5 Witness (if you do not have an identification document);
3.5.18. Signature;
3.5.19. Photograph, when there is no official identification document with a photograph
3.6 Data of legal persons;
3.6.1 Company name;
3.6.2 Trade name;
3.6.3 Date of incorporation/start of activity;
3.6.4 Type of company (UP, QT);
3.6.5 Number of signatures that bind the company;
3.6.6 Identification of the activity;
3.6.7 Corporate purpose;
3.6.8 Tax identification number;
3.6.9 Nationality of the company or of the businessperson;
3.6.10. Address;
3.6.11. Municipality;
3.6.12 Province;
3.7 All requested information must be provided, and your request may be rejected if it does not meet the established requirements.
3.7.1. Guardian's authorization (if a minor);
3.7.2. The identification document number;
3.7.3. Type of identification document;
3.7.4. Expiry date;
3.7.5. Issuing Entity;
3.7.6. Nationality;
3.7.7. Tax identification number;
3.7.8. Mobile phone;
3.7.9. E-mail;
3.7.10. Address;
3.7.11. Municipality;
3.7.12. Province
4. THE FACI-X SERVICES
The FACI-X Services are made available in compliance with the following conditions of use:
4.1 FaciAngola ensures that the FACI-X Services are available at all times;
4.2 The FACI-X Services are not free from deficiencies and factors, such as (including, but not limited to, natural disasters, geographical topography, weather conditions, planned maintenance, updates, or rectification work on the network, which may negatively interfere with the quality and provision of the FACI-X Services;
4.3 In the event of damage, loss or theft of the access data or mobile phone, the Customer is required to inform FaciAngola-Payment Services Provider, S.A., immediately of such damage, loss or theft. Thus, it will be possible to deactivate the account affected by the damage, loss or theft in order to prevent future use of the FaciAngola Services;
4.3.1 The Customer shall be responsible for all Charges and Transactions carried out up to the moment of receipt of their notification of theft, loss or damage. The notification of any damage, loss or theft may be given by telephone from the Customer Support Service. The Customer releases FaciAngola - Payment Services Provider, Lda, from any situation of conflict and/or indemnity resulting from any claims made in relation to any Transactions carried out with their devices before the notification was recorded;
4.4 The Customer accepts that FaciAngola may disclose or receive personal information or documents about them, in the following circumstances:
4.4.1 To and from local or international law enforcement entities or any competent regulatory or governmental entities, to assist in the prevention, detection or suppression of criminal or fraudulent activities;
4.4.2 To and from our distributor service providers, Agents or any other company that may be or become our subsidiary, parent company or partner, for reasonable commercial purposes, related to the use of the FACI-X Services, such as marketing and research for related purposes;
4.4.3 To facilitate FaciAngola's ability to carry out any activity in the context of a legal, governmental or regulatory requirement;
4.4.4 To FaciAngola's external lawyers or auditors, or to the Court in connection with any legal action or inspection process (even though any of these processes may be of a public nature);
4.4.5 To FaciAngola's partners (Commercial Banks, Commercial Companies) in the context of the investigation of fraud in the payment channels, which have been carried out through and/or to your FaciAngola Account involving such entities;
4.4.6 The processing of your personal data is subject to FaciAngola's Privacy and Data Protection Policy, and in accordance with the Data Protection regulation in force in Angola;
4.4.7 The customer shall comply with all instructions received in relation to the FACI-X Services;
4.4.8 All communication costs are not attributable to FaciAngola;
4.4.9 Your calls, e-mails or SMS may be monitored or recorded for use in business practices such as quality control, training, continuous improvement of the operation and systems, prevention, detection of crimes.
5. ACCEPTANCE AND COMMENCEMENT OF THE CONDITIONS OF USE
These conditions of use, as well as any amendments, are deemed accepted:
5.1 Upon registration; or
5.2 Upon signing a digital contract.
6. SUSPENSION AND DISCONNECTION OF SERVICES/CLOSURE OF THE ACCOUNT
6.1 Your Account will be closed at your request;
6.2 We may suspend, limit, restrict or cancel the provision of the FACI-X services (in whole or in part) and/or close your Account, unilaterally and without any liability, observing the regulatory notice periods in the following circumstances:
6.2.1 If we become aware or have reason to believe that your mobile equipment or access password used in connection with the FACI-X Services is being used in an unlawful, illegal, improper or fraudulent manner, or in criminal activities (or has been so used previously);
6.2.2 If the Customer fails to comply with any of the conditions relating to the FaciPay Service, including these Conditions of Use;
6.2.3 If you notify FaciAngola that your mobile equipment has been lost or stolen, or your access password has been lost or disclosed to third parties;
6.2.4 If, depending on the use given to your mobile equipment, we consider that it may harm or affect the operation or security of the network or the FACI-X services;
6.2.5 Due to a change in the regulation or legislation in force, in accordance with the guidelines issued by the supervisory body;
6.2.6 For reasons beyond the control of FaciAngola - Payment Services
Provider, Lda;
6.2.7 In the event of closure of your Account under clause 6.2;
6.3 If the account is inactive for a period of 24 (Twenty-Four) consecutive months, it will be automatically closed by FaciAngola – Payment Services Provider, Lda, and any electronic money existing therein will be transferred to the account indicated by the holder in their instruction;
6.4 Your Account will likewise be closed upon receipt of your request for that purpose.
6.5 Whenever the use of your access password is suspended, or disconnected, or your Account closed, any balance will be returned/refunded to you in cash or by transfer to a FaciAngola Account that you indicate, upon submission of a request directed to the Customer Support Center with proper identification;
6.6 FaciAngola is not liable to you for any direct, indirect, consequential or special damages, arising from any acts or omissions of ours or of third parties for whom we are responsible, whether arising from contract or statute, in the event of closure or suspension of your Account under this clause 6;
6.7 When you reach the annual transaction limit set for each type of Account;
6.7.1 In situations where you reach the reserved annual transaction limit, your Account will no longer be able to receive credit movements until the beginning of the following civil year; however, you may freely transact the existing balance;
7. PRICE LIST
7.1 The published price list is paid to FaciAngola, for each transaction carried out from your Account. The price list is available on this website, at the Agents and mobile application; whenever you wish, you may request the information of the price list through the various communication channels;
7.2 The amount payable on each transaction will be deducted from your FaciPay account upon completion of each operation, and your new balance will appear in the application;
7.3 A monthly statement will be sent to you by e-mail with the history of transactions carried out;
7.4 The fees include Value Added Tax-VAT, and are subject to changes in accordance with the regulation in force;
7.5 FaciAngola may change the applicable price list at any time in accordance with the law in force.
8. TRANSACTIONS
8.1 All Debit Transactions from your Account will be carried out by authorized transfer instructions with the access password you choose upon your activation, or by another method that, from time to time, we may update;
8.2 Your Account will be credited when you acquire electronic money, make payments or when electronic money is transferred to the FaciPay Account of another Customer and all such amounts will be held by FaciPay's management in your favor;
8.3 You will not be able to carry out any transaction from your Account if you do not have sufficient electronic money available in your Account to cover the transaction amount and applicable charges;
8.4 The FaciPay technological platform will verify, confirm and reconcile all transactions carried out on your Account. FaciPay's records shall always be deemed correct and true, unless the contrary is duly proven;
8.5 By activating the FaciPay Service, you may carry out the following transactions:
8.5.1 Carry out Credit Transactions by making cash payments directly to an Agent in exchange for an equivalent amount of electronic money to be credited to your Account. After a Credit Transaction, the FaciPay System will credit your Account accordingly;
8.5.2 Carry out Debit Transactions through:
8.5.2.1 Exchange of electronic money for cash at any Agent, by sending a FaciAngola Transfer Instruction under which the Agent will pay the equivalent amount in cash;
8.5.3 The Transfer of electronic money to another Customer, by sending FaciAngola Transfer Instructions on behalf of the said Customer, specifying the amount to be transferred;
8.5.4 The acquisition of Goods and/or Services from authorized Merchants through Transfer Instructions via FaciAngola of the amount to be transferred to the Account of the authorized Merchant in settlement of the Goods and/or Services acquired;
8.5.5 Upon any Credit and Debit Transaction that is carried out, FaciPay will credit or debit your Account, as soon as the amount is effectively credited, withdrawn or transferred from your Account;
8.5.6 Any transaction that is not completed within 7 (seven) days after the Transfer Instructions will be automatically canceled and an SMS notification will be sent to you regarding the cancellation;
8.5.7 FaciPay will confirm any transaction carried out by means of an SMS or push notification; in order for the payment order to be duly initiated and executed, the service user receives information about the payment order they intend to carry out. As a rule, the payment order is immediate; however, the maximum execution period of the payment operation, in the case of a Multicaixa-express transaction, is 1 hour. You receive the information of the charge payable for each operation, when applicable.
The service user, after executing the transaction order, receives by SMS or Push Notification the confirmation that the initiation of the payment order in the payer's account was successful. The application then generates a reference detailing the type of operation carried out, with the following content: the identification of the payer and of the beneficiary, the payment operation, the amount of the payment operation, the date and time of the payment operation and other information transmitted with the payment operation. This reference allows the payer and the beneficiary to identify the payment operation and allows the beneficiary to identify the payer.
8.5.5 Any Debit transactions carried out using the verification code will be charged to the Account. The Customer acknowledges that, unless and until FaciAngola receives a notice from them informing that their codes are no longer secure and/or that their Mobile Equipment has been mislaid or stolen, it will continue to rely on the use of the codes as conclusive proof that any transactions were authorized by them, even if they were carried out without their authorization. FaciAngola – Payment Services Provider, will not require any written confirmation of any Transaction Instruction;
8.5.6 It will not be possible to reverse or return any Transfer Instruction for any reason, including in the event of a dispute with any other Customer or authorized Merchant. The Customer is responsible for settling any dispute arising with any other Customer or authorized Merchant without recourse to FaciAngola - Payment Services Provider, Lda;
8.5.7 Your Account may only be operated through Agents/Merchants located in Angolan territory.
9. MAXIMUM ACCOUNT USAGE LIMITS
The following limits are applicable to FaciPay Accounts:
9.1 Maximum account balance:
Type I Account – Kz 50.000,00
Type II Account – Kz 600.000,00
Type III Account – Kz 6.000.000,00
Type IV Account – Kz No limits
9.2 Monthly limits of amounts to be transacted:
Type I Account – Kz 35.000,00
Type II Account – Kz 150.000,00
Type III Account – Kz 1.000.000,00
Type IV Account – Kz No limits
9.3 Daily limits to be transacted:
Type I Account – Kz 25.000,00
Type II Account – Kz 25.000,00
Type III Account – Kz 100.000,00
Type IV Account – Kz No limits
9.4 Any transaction that exceeds the prescribed transaction limits will not be processed;
9.5 Any changes made to the limits will be communicated;
10. SECURITY AND UNAUTHORIZED USE
10.1 Only one access code may be linked to your Account at any time;
10.2 The Access Code, the Security Code as well as any other codes or means of access that may be made available to the Customer are strictly personal and non-transferable.
10.3 The Customer's identification/validation procedures have been subject to a maximum number of 3 failed attempts, which will be defined by the Bank
10.4 Only the holder may use their account;
10.5 The Customer is responsible for the security, for the correct use of their Mobile Equipment, for the safekeeping of their codes and, for all transactions carried out on their Account, which means that every instruction or operation carried out through the valid Access Code and Security Code is presumed to be carried out by the customer.
10.5 You must not reveal your codes (access and verification password) to third parties, including the Customer Support Service team and the Agents.
11. YOUR RESPONSIBILITIES
11.1 The Customer is responsible for all charges applicable to the fees of any transaction carried out, including telephone calls, whether made by them or by a third party, with or without their authorization or knowledge;
11.2 The Customer is solely responsible for any material transmitted and or communication, considered defamatory, unlawful or in violation of any copyrights, and shall indemnify and hold harmless against any claims and expenses made against FaciAngola;
11.3 You must not use the Services for the commission of any offenses or unlawful acts under the national regulation in force;
11.4 The initiation and completion of transactions through your FaciPay Account are considered to be carried out by the holder and under their sole responsibility, thus releasing FaciAngola from any errors, failures, etc., that may occur in the course of such transactions;
11.5 You shall be considered solely responsible for the frauds you suffer resulting from your violation of the provisions of clause 10 above regarding the making available or the exposure of the security codes to third parties.
12. AMENDMENTS
12.1 FaciAngola - Payment Services Provider, Lda, reserves the right to change, at any time, in accordance with the law in force, the Terms and Conditions of Use of the FaciPay Service. The changes will be notified to you in the form of e-mail, notification in the application, and through the website as having been notified of any changes;
12.2 By continuing to use the FACI-X Services, you accept the changes provided for in Clause 12.1 above. If you do not accept them, you must refrain from carrying out any transactions, and the use of the FaciPay Service will be considered as acceptance of such modifications;
13. LIABILITY AND EXCLUSIONS
13.1 In the event that FaciAngola has its license revoked or canceled by the central bank, or for any other reason, its liability shall be limited to maintaining your Account and, whenever possible, transferring your Account to a new service provider, at no cost, and the Credit/Debit balance available in your Account in cash;
13.2 As far as possible and permitted by law, warranties of all kinds, express or implied, are excluded;
13.3 All Agents are independent, authorized by FaciAngola, by means of a contract entered into for that purpose.
13.4 The Agents are corporate partners approved by FaciAngola, to provide FaciAngola Services, and there is no agency relationship between FaciAngola – Payment Services Provider, Lda, and the Agents; under these terms, no liabilities fall for defect or negligence on the part of the Agents who provide the FaciAngola Services, without, however, failing to provide assistance when this proves strictly necessary.
13.5 FaciAngola is not liable for any loss that the Customer may suffer, unless it was the direct result of its negligence or willful act. In acting negligently or erroneously, we shall only be liable for the amount of the loss that a normal Customer in their situation would have suffered and, not any loss that results from their specific circumstances; even if the circumstances are atypical.
14. MISCELLANEOUS
14.1 These Terms and Conditions form a legally binding contract for you;
14.2 This Contract may not be assigned to third parties;
14.3 No failure or delay by us in the exercise or remedy shall serve as a waiver, and no single or partial exercise of any right or remedy shall prevent the future exercise or the exercise of any other right or remedy;
14.4 The rights and remedies provided for in this instrument are cumulative and not exclusive of other rights and remedies provided for by law;
14.5 If any provision of these Terms and Conditions is deemed by any duly appointed arbitrator, court or competent administrative body to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions and all provisions thus not affected by such nullity or unenforceability shall remain in full force and effect;
15. STATEMENTS
15.1 You may obtain information about the balance in your Account and consult Transactions carried out by using the Facipoint menu or on the FaciPay platform;
15.2 The printed statements of your Account will be made available by e-mail on a monthly basis.
16. LIABILITY FOR DAMAGES
16.1 FaciAngola - Payment Services Provider Lda, is not liable for damages, losses or harm caused by circumstances beyond its control, including:
16.2 Any loss resulting from Force Majeure, including, natural disasters;
16.3 Deficient Security of the devices used by the Customer;
16.4 Improper access by unauthorized persons to the Customer's devices, as well as to the Account access data;
16.5 Lack of access to fixed or mobile communication operators for data transmission in the context of the Electronic Banking Channels.
17. COMMUNICATION
17.1 We reserve the right to send information via SMS to the contact mobile phone number or e-mail associated with your FaciPay Account, and these SMS's are of an informative character only and do not require a response on your part;
17.2 You may send any correspondence to the address: Condomínio Belas Business Park – Edifício Bengo, 1st floor, room 109 – FaciAngola – Payment Services Provider, Lda;
17.3 The Customer shall pay all fund recovery expenses that are due, including lawyers' fees, collection fee and tracking fee. A certificate signed by any one of our managers (whose appointment need not be proven), showing the amount of the debt is sufficient proof of the facts stated in the certificate, unless the contrary is proven;
17.4 FaciAngola- Payment Services Provider, Lda, shall be liable for any indirect, consequential or special damages, arising from any act or omission committed by it or by third parties for whom it is responsible and if arising from contract or statute;
17.5 The Customer shall notify FaciAngola immediately in the event of changes to their data as stated at the time of initial registration, under penalty of cancellation of their Account;
17.6 The Customer agrees that their information, including personal information, their conversations with the Customer Support Service and Transactions be recorded and stored for record-keeping purposes and further for a minimum of 10 (ten) years counting from the date of closure of their Account;
17.7 All copyrights, registered trademarks and other intellectual property rights used as part of the FACI-X services or contained in the records/documents belong to FaciAngola-Payment Services Provider, Lda, or to its licensors, and you further agree that you will not acquire or claim any right over them;
18. COMPLAINTS
18.1 For the management of your complaints, the Customer has several channels for that purpose, and to do so should submit a complaint through a telephone call to the Customer Support Line +244 959 019 001, by e-mail atendimento@faci-x.ao, by WhatsApp or by letter;
18.2 FaciAngola - Payment Services Provider, Lda, is regulated by the legal provisions of the National Bank of Angola, and if the Customer is not satisfied with such process, they have the right to submit a complaint to the regulator through the e-mail atendimento.reclamacoes@bna.ao or by telephone at the number +244 222 67 92 44;
18.3 The Customer may also resort to the consumer protection entities in Angola, namely:
18.3.1. The consumer associations, under the terms of the Consumer Protection Law;
18.3.2 The National Institute for Consumer Protection; and
18.3.3. The centers for arbitration, conciliation and mediation of conflicts, under the applicable terms.
18.3.4. Court.
19. REFUNDABLE CHARACTER
19.1 The customer has the right to request a refund of the monetary amounts at any time:
19.2 The refund request must be made by the account holder or by their legal representative.
19.3 FaciAngola carries out the refund of the monetary amounts within 1 (one) business day.
19.4. The refund is made to the account indicated by the author of the request.
19.5 A commission is applicable to the refund if the customer requests it before the end of the contract, or if they request it after one year from the end of the contract.
20. LAW AND JURISDICTION
20.1 This Contract is governed by the Angolan legislation in force;
20.2 Any disputes arising from or in connection with this Contract must first be resolved through an out-of-court solution, failing which they must finally be resolved in accordance with the provisions of the Angolan arbitration laws and the rule of Harmonia – Integrated Center for the Study and Resolution of Conflicts. The arbitration will be conducted by 1 arbitrator.
20.3 The Court will operate in Luanda and in the Portuguese language;
20.4 To the extent permitted by law, the arbitrator's decision shall be final, conclusive and binding on the parties to this instrument.
